Major Tribunal and employment law reforms

The Government has just confirmed that there will be a fundamental review of Employment Tribunal procedure and has published its response to its Consultation on Resolving Workplace Disputes. The announcements by Vince Cable, the Business Secretary, are being referred to as ‘the most radical reform to the employment law system for decades’.

The main proposals are:

  • confirmation of the recent proposal that the unfair dismissal qualifying period should increase to two years;
  • obligatory presentation of all claims to ACAS, for an attempt at mediation, before they can be lodged with the tribunal;
  • consultation on the introduction of ‘protected conversations’, with the proviso that they will not extend to protect discriminatory acts;
  • consultation on reducing the minimum period for redundancy consultation to 60, 45 or 30 days;
  • potential 3-month ‘rapid resolution scheme’ for straightforward employment claims;
  • complaints about breach of employment contract to be removed from whistle-blowing law;
  • discretion given to Employment Judges to order financial penalties against employers who breach employment rights;
  • Employment Judges to sit alone (without Wing Members) in unfair dismissal cases;
  • CRB checks to be ‘portable’ (so no need for a fresh application when moving jobs); and
  • a further look at maternity and paternity leave to place greater emphasis on involvement for fathers.

The A303 Meet-up is a quarterly HR forum we run in partnership with J Mann Associates near Amesbury, Wiltshire. It is aimed at HR professionals and managers with HR responsibilities. Members are drawn from a spectrum of organisations, including owner-managed businesses, educational bodies and charities. We meet for a working lunch and informal discussion of a current employment law/HR topic.

Recent topics have included ‘Atypical workers - avoiding liabilities’ and members appreciate the opportunity to brush-up their knowledge, pick up practical tips and network with peers in the area.

South Wales HR Forum:
We run an HR Forum for South Wales HR Managers and other interested people each quarter. It is an informal, relaxed and confidential discussion group at which we lead with a different discussion topic each time and hear the views and experiences of those attending.

Our topics cover forthcoming changes in employment law and practical tips on how to handle complex processes. A recent example is a ‘master class’ style analysis of what makes the perfect redundancy process. It’s a great way of keeping up to date, getting useful tips and networking with your HR peers in the region.
