Case update (3): Uber drivers are ‘workers’ – no appeal

What do we already know?

We updated you in our November 2017 Newsflash Uber drivers are ‘workers’ and our November 2017 Newsletter Case update (1): Uber drivers are ‘workers’ on the EAT’s decision that drivers who provide services to the online taxi firm, Uber, are ‘workers’, rather than self-employed.

We also told you that Uber were likely to appeal the decision and may seek a leapfrog appeal to the Supreme Court (so that the case could be heard at the same time as Pimlico Plumbers v Smith on 20-21 February 2018).

What’s new?

The Independent Workers Union of Great Britain has confirmed that Uber’s request for leave to appeal directly to the Supreme Court has been refused.

It is believed that instead the Court of Appeal will hear Uber’s appeal at some point next year.
