Government reforms (2): Tribunal fees judicial review

tribunal fees - stack of pound coinsAs we mentioned in our September 2013 Newsletter, we’re still waiting to see whether Tribunal fees will enjoy a long and healthy life. We were hoping for an indication as to their health to be given by the Court of Session in Edinburgh in its judicial review of the scheme on 26 September 2013. However, the Court of Session has stayed the Scottish judicial review proceedings for another six months. This is on the basis that it raises the same issues as the application for judicial review brought by Unison in the High Court in London. Unison’s High Court hearing took place on 22 and 23 October 2013 but as we go to press no judgment has yet been reported. The Ministry of Justice has undertaken to refund any Tribunal fees paid if the fee scheme is ultimately held to be unlawful.
