What do we already know?
In our January Newsflash Tribunal fees we updated you that the High Court had rejected Unison’s second challenge to Tribunal fees. This was despite Unison’s challenge being supported by Tribunal statistics showing a significant reduction in the number of Tribunal claims since the introduction of fees. Unison is to appeal this decision to the Court of Appeal.
What’s new?
The Business Secretary, Vince Cable, has launched a review of the impact of Tribunal fees, particularly whether they are a barrier to justice. The drop in the number of claims and the above failed judicial review challenge prompted calls for a review, including from Jo Swinson, Employment Relations Minister. Mr Cable has stated that he will publish the findings of his review in a few weeks.
