In our December newsletter Holiday pay news we let you know that we were expecting guidance from the English and Scottish Presidents of the Employment Tribunals in relation to case management of holiday pay claims.
The above Presidents have now published practice directions on holiday pay claims.
The Practice Directions are not as helpful as we might have hoped, but do confirm that a claimant who has already presented a holiday pay claim to the Tribunal can apply to amend the claim to add further complaints of alleged underpayments, if these further claims could not have been included in the original claim. If new claims are added by amendment then no further fee need be paid.
