Legal Advice Costs Information

Taking legal advice can be expensive.  There is generally no Legal Aid available for employment law advice (with the exception of some discrimination claims).  Here are some options to consider;

  1. Legal Expenses Insurance

Some of our employee clients wish to consider if their Legal expenses insurance can cover some or all of their legal advice costs.  Legal Expenses Insurance can be complicated.  We would recommend you read more about it at: Legal expenses insurance (financial-ombudsman.org.uk).    This section states that “Panel solicitors are normally used up to the point when it’s decided that there’s a need for legal proceedings. At that point a policyholder would have the right to choose their own solicitor” and “a policyholder should be allowed to choose their own solicitor from the point that legal proceedings need to be started – ie when negotiations have failed and it has been decided, by the solicitors involved, that it will be necessary to issue proceedings to progress the legal case”.

Every policy is different.  If you have Legal Expenses cover do read your policy document and contact the insurer to find out more.  There will be strict conditions for every policy and we cannot guarantee that any of our legal advice costs will be covered by Legal Expenses Insurance.

  2. Your Union may be able to offer some legal advice and support  (if you are a member of one)
  3. ACAS helpline – can explain the law and options but is impartial so does not give legal advice
