The Government’s eagerly awaited Response to its Consultation on future changes to TUPE is finally here.
The changes are intended to simplify the TUPE Regulations, remove ‘unfair’ legal risks faced by organisations and reduce the bureaucracy of a transfer. However, the Response does not include the new draft Regulations, nor an expected implementation date (although the Government has informally suggested the implementation date will be January 2014).
Most importantly, despite widespread speculation otherwise, it seems likely that TUPE’s application to service change provisions is here to stay, and will not be removed after all. We will discuss the implications of this and the changes with which the Government is pushing ahead, in our September Newsletter.
