Increase in Discrimination Awards from 6 April 2024

There are three levels of bands for compensation for injury to feeling as a result of discrimination (known as ‘Vento’ bands, after the 2002 case by that name).

The ‘Vento’ award bands for claims presented on or after 6 April 2024 are:

• £1,200 and £11,700 for the lower band (less serious cases);
• £11,700 to £35,200 for the middle band;
• £35,200 to £58,700 for the upper band—the most serious cases;
• £58,700 and above for the most exceptional cases.

In deciding which Vento band an injury to feelings award may fall into, the key consideration is always the effect that the discriminatory act(s) has had on an individual.

A Tribunal will have regard to various factors including, but not limited to, the sensitivity of the employee to the employer’s conduct, stress, medical conditions, and the impact of the discrimination on the employee’s career.
